my son attends a private pre-k program. the school is not peanut free and to my knowledge does receive federal or state funding for anything. i am meeting some real resistance from them suddenly regarding nut products in his classroom. they have been given his medical records and there has been enough discussion about his allergies that they know what he is allergic to. it’s a small school and he is the only student in his class with allergies. does the federal government have jurisdiction even though the school does not receive government funding?

Jonas,
This is a tougher situation. First off federal laws typically apply to schools that “do” receive some sort of gov. funding. Since your school is private and does not receive any funding – you’d be hard pressed to get any agency involved.
Since it is a small school and a private one, I suggest going in and discussing the issue with them, what you need and reminding them that should your son suffer an allergic/life threatening reaction due to their resistance in giving your son a safe learning environment – then they of course are legally liable. I would also consult with your allergist to see if you can get a Dr. note stating what it is your son needs in this school and his classroom to keep him safe.
